Angry motorist set to take council to court over pothole damage to his car

Pot holes on Crackley Lane could land Warwickshire County Council in the small claims court.
Motorist Ian Williamson says he is so fed up with the road and damage to his car as a result of the pot holes, he plans to take the council to court to claim back hundreds of pounds he has had to shell out to fix the vehicle.

Mr Williamson has bee
n in contact with the county council for a number of weeks and says that he is ‘surprised’ that despite the number of reports made to them by him on the issue, the road still remains in a ‘dangerous condition’ for all road users.

He said: “I have informed them of a number of road defects. The road still remains unrepaired since I made them aware of my incident on November 24 2007. I have written to them on a number of occasions.

“I have highlighted deficiencies in a repair they did of the pothole, which was completed on the area of road where the damage was caused to my vehicle.

“In contrast I have highlighted permanent repairs on areas within the highway, which fall within the same region of the road in relation to the positioning of the pothole where damage was caused.”

He added: “The area in which my vehicle sustained damage is within the parameters of the Highway and therefore the responsibility of Warwickshire County Council. I have been to seek legal advice and am told I have a very good case.”

A Warwickshire County Council spokesperson said: “We are not aware of any recent problems.

“It is inspected annually by our safety inspector and on a very regular basis by area inspectors.

“A recent inspection at the start of this month did not reveal any dangerous defects in Crackley Lane.

“When we are aware of any problems, we action any necessary repairs.”
